Board of Health advances Kratom regulation framework for legal review

Ashland Board of Health discusses Kratom regulation allowing natural leaf while banning synthetic products. Vice Chair Jay Byrnes presented a draft regulation modeled on House Bill 4394 pending in the Massachusetts Legislature, which would prohibit 7-hydroxymitragynine and concentrated forms while permitting regulated natural Kratom leaf and powder. The framework requires retailers to provide Certificates of Analysis from manufacturers and aligns with the Kratom Consumer Protection Act and FDA guidance.
Public comment divided between residents advocating complete ban following deaths from Mitragynine toxicity and users citing therapeutic benefits for pain and anxiety. Chair Ed Burman directed Rajit Gupta, Health Agent and Director, to have Town Counsel review the draft before board adoption.
